Terms of Service
The short version, in plain English.
We design, build, host, and secure your website for a flat monthly fee. This page covers the legal detail behind that arrangement. Questions? Email us, we’re happy to explain anything here in plain terms.
1. What’s included
Your subscription covers the design and build of your website, its ongoing hosting, security, and maintenance, and minor tweaks to existing content (text and image changes, for example). It doesn’t cover structural redesigns, new pages or features, or work outside the scope of your original site — we’ll always quote separately for anything beyond a minor tweak before doing it.
2. Ownership
Topos owns the website platform, its underlying code, design templates, and the hosting infrastructure it runs on. Your subscription grants you the right to be represented online by your site for as long as your account is active and in good standing — it doesn’t transfer ownership of the site or platform to you. You retain ownership of your own business content: your logo, photos, and the words you give us to work with.
3. Billing
Your subscription is billed monthly in advance, starting on the day you sign up, in Australian dollars and inclusive of GST. Card details are stored securely by our payment processor, Stripe — we never see or hold your card details ourselves.
4. If a payment doesn’t go through
If a scheduled payment fails or your subscription otherwise falls behind, we’ll try to let you know and give you a reasonable chance to fix it. If the account isn’t brought current, we may suspend or take your site offline without further notice. Continued non-payment may result in your site being permanently removed and its content deleted.
5. Your content
You’re responsible for the text, images, logo, and other material you provide us, and for making sure you have the right to use it. We’ll use what you give us to build and maintain your site, and won’t use it for anything else without asking.
6. Ending your subscription
You can end your subscription at any time by emailing us. Cancellation takes effect at the end of your current billing period — we don’t offer partial refunds for time already paid for. Once your subscription ends, your site will be taken offline, since the site only exists on our platform for as long as the subscription covering it is active.
7. Liability
We aim for your site to be fast and reliably available, but we can’t guarantee it will never go down, and we’re not liable for lost business, revenue, or data arising from downtime or issues outside our reasonable control. Nothing here limits any liability that can’t be excluded under Australian law.
8. Changes to these terms
We may update these terms from time to time. We’ll post the updated version here, and continued use of your site after a change means you accept the update.
